  1. Introduction
    1.1 By accessing and/or using the Dots Creative Website or registering with Dots Creative as a Member, Exhibitor or Sponsor you agree to be legally bound by these Terms and Conditions and Privacy Policy, which shall take effect immediately on your first use of this Website. If you do not agree to be legally bound by all of the following Terms and Conditions and Privacy Policy please do not access and/or use this Website, or register with Dots Creative as a Member, Exhibitor or Sponsor.
    1.2 Dots Creative operates this Website dedicated to the construction industry in the area of green buildings and associated products and services in support of sustainability in the construction industry.
    1.3 The Website allows Users to become Members entitling them to Member Benefits as listed in Section <14> of these Terms and Conditions and Privacy Policy.
    1.4 The Website also allows Users to become Sponsors entitling them to Sponsor Benefits as listed Section <15> of these Terms and Conditions and Privacy Policy.
    1.5 The Website also allows Users to become Exhibitors entitling them to Exhibitor Benefits as listed in Section <16> of these Terms & Conditions and Privacy Policy.
    1.6 Members, Sponsors and Exhibitors and any users of the Website are subject to the Terms and Conditions and Privacy Policy set out herein.
    1.7 These Terms and Conditions and Privacy Policy are subject to change without prior notice and such changes shall be effective immediately when posted on the Website.
    1.8 Dots Creative shall have the sole discretion and final decision on all matters regarding the Tradeshow including any physical or online component, features and benefits relating to the Tradeshow prior to, during or after the Tradeshow, which are all subject to change without prior notice.

  2. Definitions
    The following words and/or phrases set-out in the Terms and Conditions and Privacy Policy herein shall have the corresponding meanings given below:
    2.1 "Compilation" means the collection, arrangement and assembly of all Materials on the Website.
    2.2 "Consent" means expressed or implied voluntary agreement with what is being done or proposed.
    2.3 "Dots Creative" or "the Company" means Dots Creative Company Limited, the legal entity that owns and operates the Website.
    2.4 "e-mail" means electronic mail sent or received via the Internet.
    2.5 "Exhibitor" means an individual, company or Organization registered with Dots Creative having the rights and benefits set out in these Terms and Conditions and Privacy Policy, including the obligations and responsibilities set-out in section <16> below.
    2.6 "Express Consent" means Consent given explicitly, either orally or in writing and is unequivocal and does not require any inference on the part of the organization seeking consent.
    2.7 "Implied Consent" means Consent which may reasonably be inferred from the action or inaction of the individual.
    2.8 "Intellectual Property Rights" means all copyright, design rights, patents and any rights to inventions, know-how, trade and business names, trade secrets, domain names and trade-marks (whether registered or unregistered) and any applications thereof.
    2.9 "Member" means an individual, company or Organization registered with Dots Creative having the rights and benefits set out in these Terms and Conditions and Privacy Policy, including the obligations and responsibilities set-out in section <14> below.
    2.10 "Material" means the contents of the Website, such as text, graphics, images, video, music, logos, button icons, links, HTML code, trademarks, software and other material.
    2.11 "Organization" means an entity, including association, partnership, corporation, person and trade union, adopting and complying with the obligations set out in the Terms and Conditions and Privacy Policy.
    2.12 "Personal Information":
    1. means information about an identifiable individual recorded in any form and includes, but is not limited to, such things as name, date of birth, gender, contact information, ICQ number, e-mail address, credit card details, race, ethnic origin, colour, age, marital status, religion, education, medical history, criminal history, employment history or financial history, address, telephone number, numerical identifiers such as the Social Insurance Number, and views and personal opinions;
    2. does not include the name, title or business address or telephone number of an employee of the organization; and
    3. does not include public available information, such as a public directory listing of your name, address, telephone number and electronic address.
    2.13 "Registration Information" means information required by Dots Creative to register a Member, Sponsor or Exhibitor or to register for any event organized by Dots Creative. The information required appears on the registration or 'sign-up' page of the Website or in any other form in digital or print format that are filled in or submitted to Dots Creative manually or digitally.
    2.14 "Services" shall mean services offered to Users, including Members, Sponsors and Exhibitors on the Dots Creative Website set out in section <14> with respect to Membership, section <15> with respect to Sponsors and section <16> with respect to Exhibitors.
    2.15 "Sponsor" means an individual, company or Organization registered with Dots Creative having the rights and benefits set out in these Terms and Conditions and Privacy Policy, including the obligations and responsibilities set-out in section <15> below.
    2.16 "Terms and Conditions and Privacy Policy" means the terms and conditions for access to and use of the Dots Creative Website and to register as a Member, Sponsor or Exhibitor.
    2.17 "Tradeshow" means the tradeshow exhibited on the Website consisting of (1) the Opening Ceremony, which is a physical event, and (2) the Online Exhibitions where all show booths are hosted on the Website.
    2.18 "User" means, but is not limited to, visitor, Member, Sponsor, Exhibitor, advertiser and any other person or company or organization viewing or using information or Material posted on the Website.
    2.19 "User Content" means all information, data, text, graphics, images, video, slide shows, music, logos, button icons, links HTML code, trade-marks, software and other Material and Compilation of such Material made available for inclusion on the Website whether uploaded directly, e-mailed, transmitted or delivered physically or digitally by the User.
    2.20 "Website" means the website www.buildingtradeshow.com hosted by Dots Creative on the Internet for operating and providing the Services.
    2.21 "Website's Goal" means the objective of the Website, which is to provide a positive online environment for sharing of experience and information to promote and enhance interest and development in the construction industry in the area of green buildings and associated products and services in support of sustainability in the construction industry. Users, members, exhibitors and sponsors are expected to support and respect each others contribution towards this goal.

  3. User Content
    3.1 The User agrees and acknowledges that User Content submitted or uploaded to the Website will be shared. The User further agrees and acknowledges that:
    1. User Content, whether publicly or privately posted or transmitted, shall be the sole responsibility of the User from which the User Content originated;
    2. User Content submitted or uploaded to the Website by any User shall be strictly for the support of the Website and the Website's Goal;
    3. the User shall only submit or upload User Content to the Website for which that User has Intellectual Property Rights which includes copyright;
    4. the User shall be solely responsible for the form, content and accuracy of any User Content placed on the Website by that User or from that User;
    5. the User shall be responsible for all User Content that the User submits, uploads, posts, e-mails, transmits or otherwise makes available through the Website or any service of Dots Creative;
    6. the User shall bear all risk associated with viewing and using the User Content:
      1. in part or in whole; and
      2. including, but not limited to, its original form as submitted by the User or as modified, adapted, translated, copied, compiled or distributed in any way by the Website or Dots Creative;
    7. the User shall not rely on any User Content in part or in whole for accuracy, usefulness or completeness;
    8. the User shall grant Dots Creative a worldwide, royalty-free and non-exclusive license:
      1. to use, distribute, reproduce, modify, adapt, translate, publish, publicly perform and publicly display User Content in whole or in part; and
      2. to incorporate User Content into other works in any format or medium known or developed now or in the future and to be used by Dots Creative and the Website;
    9. Dots Creative does not control the User Content and does not guarantee the accuracy, integrity or quality of any User Content;
    10. Dots Creative and the Website have no obligation to pre-screen any User Content;
    11. Dots Creative may pre-screen, remove, reject, block or otherwise take any other actions which Dots Creative and the Website consider necessary at their sole discretion;
    12. Dots Creative and the Website do not claim ownership or copyright of the User Content submitted; and
    13. Dots Creative and the Website may change User benefits without prior notice.
    3.2 Dots Creative and the Website shall not be liable for
    1. any User Content;
    2. any use of the User Content;
    3. any loss or damage including, but not limited to, any error, any omission in User Content or any fraud committed by any User of the Website whether any such User Content is used directly or indirectly as a result of being posted, e-mailed, transmitted, submitted or otherwise made available through the Website or any Service of Dots Creative;
    4. any risk associated with User Content; or
    5. the accuracy, usefulness or completeness, or lack thereof, of any User Content.

  4. Payment
    4.1 Upon registration by Sponsors and Exhibitors an account will be opened for such Users. The Sponsors and Exhibitors must also select one of Dots Creative's payment methods in order to deposit funds into such User's account.
    4.2 Users shall pay interest at a rate of [24]% per annum calculated for accounts due and owing.

  5. User Name, Password, Alias and Numbers
    5.1 Dots Creative shall not be required to maintain user names, passwords or account numbers and if the User misplaces, forgets or loses their password, or is otherwise unable to gain access to any pages of the Website or if any third party gains access to any pages of the Website using the User's password and/or account number. Dots Creative shall not be liable for any claims whatsoever resulting from such circumstances. The User is responsible for maintaining the confidentiality of the User's password.

  6. Registration Information
    6.1 The User is required to immediately inform Dots Creative of any change to the Registration Information by updating the User's Registration Information on the Website or, failing that, informing Dots Creative by e-mail. The User can view and update the Registration Information provided by the User at any time on the Website except for the User's full credit card number. For security reasons, Users cannot view their credit card number.

  7. Acceptable Website Use
    7.1 The User shall:
    1. abide by any and all rules, regulations, policies and Terms and Conditions posted on the Website;
    2. support the Website's Goal;
    3. respect other Users' contributions towards the Website's Goal;
    4. display and make use of the online exhibition features of the Tradeshow for display of information relating to the Tradeshow and shall not display information for other purposes;
    5. only use the Website for lawful purposes;
    6. make all payments on time;
    7. not default on any payment;
    8. not be listed with any credit bureau;
    9. not post, display or provide any information, be it Registration Information, Personal Information, or other information, that is false, inaccurate, or incomplete, or that infringes or violates the rights of any third parties including Intellectual Property Rights, or that in any way misrepresents the User or the User's interests;
    10. not post, display or provide any information or promotional material from any other third party on the Website without the written permission of Dots Creative;
    11. not transfer, sell, re-sell, sublet, trade, copy, duplicate, reproduce or exploit any User accounts, User benefits, Services, Materials, including the show booth, for any commercial or other purpose without written permission of Dots Creative;
    12. not share the User's password to the Website with any party;
    13. not use the Website to transmit, publish, upload, post or circulate any material that in the opinion of Dots Creative is unlawful, harmful, threatening, harassing, tortuous, defamatory, obscene, libellous, violates another's privacy or publicity rights, violates another's Intellectual Property Rights, including copyright, or is otherwise offensive or objectionable;
    14. not in any way manipulate any of the Material, or in any way interfere with the operation of the Web Site, including, without limitation, any transmission of software viruses or any computer code or messages designed to disrupt, interrupt or alter the operation of the Website;
    15. not defraud or attempt to cheat or defraud Dots Creative or other Users;
    16. not make defamatory, untrue or malicious comments about Dots Creative or other Users;
    17. not conduct any activity that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, Registration Information, Personal Information; and/or create liability for Dots Creative or cause Dots Creative to lose (in whole or in part) the services of Dots Creative's Internet Service Providers (ISPs) or other suppliers;
    18. not use the website for any inappropriate use;
    19. not send unsolicited mail (spam mail) to other Users via Dots Creative's messaging facility or send bulk unsolicited mail via external means to other Users, as the sending of such mail may be a criminal offence in certain jurisdictions;
    20. not use the Web site to collect information about Users of the Website; and
    21. not do anything contrary to these Terms and Conditions and Privacy Policy.
    7.2 The User agrees and acknowledges that Dots Creative provides no assistance, including the review, removal or editing of Material posted on the Website, or any customer support for the use of Material the Website.
    7.3 The User agrees and acknowledges that Dots Creative shall have the sole discretion and final decision on all matters regarding the Tradeshow including any physical or online component, features and benefits relating to the Tradeshow prior to, during or after the Tradeshow, which are all subject to change without prior notice.
    7.4 The User agrees and acknowledges that Dots Creative shall have the sole discretion and final decision to remove any Material considered inappropriate without prior notice.
    7.5 The User agrees and acknowledges that Dots Creative reserves the right in its sole discretion to change the date, time and the place at which the Tradeshow is to be held and shall not be liable to any loss or damages by reason of such change.

  8. Minors
    8.1 If you are a minor:
    1. you shall not use the Website if you would incur any legal obligations or liabilities in doing so;
    2. you shall seek advice from your parents or guardians as to the meaning and consequences of these Terms and Conditions and Privacy Policy if you wish to view and access the Website.
    8.2 Dots Creative and the Website presume that every User of the Website is of legal age. If it is discovered that any User of the Website is not of legal age, Dots Creative and the Website reserve the right as may be available against such User, or the parents or guardians of such User, including the right to cancel that User's registration without compensation or refund of any moneys paid to the Company.

  9. Link
    9.1 The Website contains links to other sites and pages which are not maintained or controlled by Dots Creative and for which Dots Creative is not responsible. When the User activates any links or pages, the User leaves the Website and access to such a site or page is at the User's own risk for which Dots Creative disclaims all responsibility and liability.

  10. Dealings between Users
    10.1 User communications, postings, responses to postings, and participation in any service posted by other Users including, but not limited to, visitors, Members, Exhibitors, Sponsors and advertisers found on or through any of the Services provided by the Website and Dots Creative are solely between such Users. Dots Creative shall not be liable for any action or consequence resulting from any dealing between Users.

  11. No Challenge
    11.1 The User shall not attack, or assist in any attack, including legal proceedings the validity or ownership of the Intellectual Property Rights of Dots Creative including, without limitation, those with respect to the Services or the Website while this agreement exists or after termination or cancellation of this agreement for any reason whatsoever. The User acknowledges and agrees that Dots Creative's Intellectual Property Rights include, without limitation, rights of copyright in the Services, Materials, Compilation, software, Website and the pages thereof.

  12. Modification, Suspension, Discontinuation, or Cancellation and Termination of Services
    12.1 This Agreement shall terminate when either the User or Dots Creative provides the other with written e-mail notification that this Agreement has been cancelled.
    12.2 With or without notice, Dots Creative reserves the right to remove, take-down or block information, materials or dates, or to modify, suspend, discontinue, or cancel a User's Services or to refuse any application for Services, where, in the sole opinion of Dots Creative:
    1. the User fails to abide by any provision in these Terms and Conditions and Privacy Policy.
    2. the User fails to perform any material condition of these Terms and Conditions and Privacy Policy or fails to abide by the rules, regulations, policy or Terms and Conditions adopted by Dots Creative for the Tradeshow; or
    3. the User breaches, infringes, violates or harms in any way the Intellectual Property Rights of Dots Creative or any other person, Company or Organization.
    12.3 Upon modification, suspension, discontinuation, or cancellation of a User's Services, Dots Creative shall not reimburse or refund a User for any fees paid to the Website or to Dots Creative unless:
    1. the Tradeshow is completely cancelled by Dots Creative provided always that no refund will be made due to changes in the Tradeshow including changes in any component or features whether physical or online; or
    2. the User cancels this Agreement by written e-mail request to Dots Creative, in which case, the process for refund shall be as follows:
      1. if such written e-mail request is received by Dots Creative not less than 60 days before the opening date of the Tradeshow, all monies paid by the User will be fully refunded;
      2. if such written e-mail request is received by Dots Creative between 59 days to 30 days before the opening date of the Tradeshow, only 50% of the total amount paid by the User will be refunded; and
      3. if such written e-mail request is received less than 30 days before the opening date of the Tradeshow, then there will not be any refund whatsoever to the User.
    12.4 Upon cancellation any credit in the User's account less handling and administrative fees will be paid to the User via the same method by which any such funds were received by Dots Creative with the exception of accounts that have been closed yet still contain unclaimed credit for a period of 365 days since date of closure.
    12.5 Upon cancellation of this Agreement, the User forfeits all rights of claims to all the benefits to the Tradeshow including the show booth, all physical and online components in part or in whole, and all the User's online exhibition materials.
    12.6 Upon cancellation of this Agreement, all of the User's online exhibition materials may be deleted by Dots Creative.
    12.7 The User agrees that the Website and Dots Creative shall not be liable to the User or any other third party for any modification, suspension, discontinuation, or cancellation of Service.

  13. Indemnity
    13.1 The User shall be liable to and shall fully indemnify, defend and hold harmless Dots Creative, its successors or assigns, associated companies, partners, co-branders employees, officers, directors, licensees, licensor, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, agents and retailers from any and all costs (legal or otherwise), expenses, claims, proceedings, damages, injuries, losses, liabilities and damages whatsoever suffered by any person or legal entity including other Users or Dots Creative and their respective agents, servants, employees or the general public if such costs (legal or otherwise), expenses, claims, proceedings, damages, injuries, losses, liabilities and damages are caused by the User.

  14. Members
    14.1 Free Membership at this Website is only available to the following:
    1. Approved professional institutes and non-profit organizations including their individual registered members.
    2. Educational institutes (universities and colleges) including their individual teaching staff and registered students.
    3. Companies that provide professional service in the design and/or development of buildings and related consultancy service.
    14.2 Member benefits are provided on this Website on a complimentary basis at the sole discretion of Dots Creative and are subject to change or cancellation without prior notice.
    1. Member benefits that are provided at this Website at no cost include an online workspace with a maximum of 20MB file storage for photos and text plus one video up to 30 minutes of duration.
    2. Members shall have the benefit of posting information to the web pages of the following special show sections of the Website:
      1. flims and videos
      2. professional showcase
    14.3 Members will be responsible to manage their own online workspace and all their own contents.
    14.4 Members shall abide by all Terms and Conditions and Privacy Policy of this Website.
    14.5 Dots Creative reserves the right to charge fee for any additional service used by members that is not listed in <14.2>.

  15. Sponsors
    15.1 There are three kinds of sponsors: Platinum Sponsor, Gold Sponsor and Green Sponsor which are provided upon payment of the required annual fee, subject to the approval of Dots Creative.
    15.2 Platinum Sponsor's annual fee shall be Canadian Dollars $10,000 plus applicable tax. The Platinum Sponsor's benefits shall include the following:
    1. sponsor shall be acknowledged in the slide show and the printed program at the opening ceremony.
    2. one online show booth for one year as provided for exhibitor in section <16> with free first time set up service available at the request of the sponsor.
    3. one online workspace for sponsor's content management and update for one year.
    4. sponsor shall be featured in the Feature Exhibitor area of the Home Page on a rotating basis.
    5. sponsor's logo included on top banner of all pages of the Website that is designated for the Green Building Tradeshow.
    6. posting of information to the web pages of the following special show sections of the Website:
      1. news
      2. flims and videos
      3. professional showcase
      4. networking opportunities
      5. publications
    15.3 Gold Sponsor's annual fee shall be Canadian Dollars $3,650 plus applicable tax. Gold Sponsor benefits shall include the following:
    1. sponsor shall be acknowledged in the slide show and the printed program at the opening ceremony.
    2. one online show booth for one year as provided for exhibitor in section <16> with free first time set up service available at the request of the sponsor.
    3. one online workspace for sponsor's content management and update for one year.
    4. sponsor shall be featured in the Feature Exhibitor area of the Home Page on a rotating basis.
    5. sponsor logo on one special show section's main page plus sponsor logo on that special show section on the Home Page when that special show section is present on the Home Page (Note: Sponsor logo does not appear on the Home Page for Show Bag and Search Result sponsors). Sponsor shall confirm the special show section which the sponsor's logo shall appear in. If no special show section is confirmed by the sponsor, the sponsor logo shall appear in the news show section.
    6. posting of information to the web pages of the following special show sections of the Website:
      1. news
      2. flims and videos
      3. professional showcase
      4. networking opportunities
      5. publications
    15.4 Green Sponsor's annual fee shall be Canadian Dollars $1,000 plus applicable tax, which does not include any online show booth. Green Sponsor benefits shall include the following:
    1. sponsor shall be acknowledged in the slide show and the printed program at the opening ceremony.
    2. one online workspace for sponsor's content management and update for one year. File storage up to maximum of 300MB total disk storage space.
    3. Sponsor logo on one special show section's main page. Sponsor logo does not appear on Home Page. Sponsor shall confirm the special show section which the sponsor's logo shall appear in. If no special show section is confirmed by the sponsor, the sponsor logo shall appear in the news show section.
    4. posting of information to the web pages of the following special show sections of the Website:
      1. news
      2. flims and videos
      3. professional showcase
      4. networking opportunities
      5. publications
    15.5 Any complimentary use of features on the Website is provided at the sole discretion of Dots Creative and is subject to change or cancellation without prior notice.
    15.6 Sponsors will be responsible to manage their own online workspace and all their own contents.
    15.7 First time set up support will be provided to sponsors for initial set up of any online show booth at no cost. Additional service shall be subject to additional fees. Request shall be submitted for the approval of Dots Creative. Any additional services shall be provided at the sole discretion of Dots Creative.
    15.8 Sponsors shall abide by all Terms and Conditions and Privacy Policy of this Website.

  16. Exhibitors
    16.1 Exhibitor's annual fee shall be Canadian Dollars $1,825 plus applicable tax. The Exhibitor benefits shall include the following:
    1. exhibitor shall be acknowledged in the slide show and the printed program at the opening ceremony.
    2. one online show booth for one year with free first time set up service available at the request of the exhibitor.
    3. one online workspace for exhibitor's content management and update for one year.
    4. exhibitor shall be featured in the Feature Exhibitor area of the Home Page on a rotating basis.
    5. posting of information to the web pages of the following special show sections of the Website:
      1. news
      2. flims and videos
      3. professional showcase
      4. networking opportunities
      5. publications
    6. Online show booth features shall include the following:
      1. company profile in English with free translation into Chinese where requested by exhibitor with up to 10 main products listed. Where Chinese translation is provided by Dots Creative, the translation shall be at the discretion of Dots Creative and Dots Creative shall not be responsible or liable for any cost or consequence for any error or incorrect translation. The exhibitor can also provide their own Chinese translation.
      2. keywords up to 100 words maximum.
      3. file storage up to maximum of 500MB total disk storage space.
      4. main feature includes one main photo and 1000 words of text description.
      5. video content of up to maximum 3 videos, each video not to exceed 30 minutes of duration and each video shall be featured in the Films and Video show section of the Website on a rotating basis.
      6. slide shows in PowerPoint format up to 3 slide shows with each slide show having one main cover image plus 100 words of text description.
      7. publications of up to the maximum of 30 publications. Each publication page includes one main photo and up to 100 words of text description, with capability of printing in PDF format or Window Word document format, add website link to exhibitor's website for purchase, posting of order form and each publication shall be featured in the Publication show page on a rotating basis.
      8. projects up to the maximum of 30 projects. Each project includes one main photo plus text description of up to 1000 words. Each project will be featured in the Professional Showcase section on a rotating basis.
      9. photo gallery shall be provided for each project for posting of up to 10 photos for each project. Each photo in the photo gallery includes a photo image and text description of up to 50 words.
      10. show bag shall be provided at each online show booth to enable visitors to collect exhibitor's information.
    16.2 Complimentary use of features on the Website is provided at the sole discretion of Dots Creative and is subject to change or cancellation without prior notice.
    16.3 Exhibitors shall be responsible to manage their own online workspace and all their own contents.
    16.4 First time set up support will be provided to exhibitors for initial set up of any online show booth at no cost. Additional fee may be required for management of the online show booth subject to review and at the sole discretion of Dots Creative.
    16.5 Exhibitors shall abide by all Terms and Conditions and Privacy Policy of this Website.

  17. Intellectual Property Rights, Copyright and Trade Marks
    17.1 Unless otherwise specified, all Intellectual Property Rights in and related to the Website, Services, Materials and Compilation are the exclusive property of and vest in Dots Creative or its content suppliers or clients, or are licensed to Dots Creative. All such rights of Dots Creative are hereby asserted and reserved. The unauthorized use of the Materials or Compilation violate Intellectual Property Rights, including copyright and trademark.
    17.2 No person or entity other than Dots Creative, the rightful owner or licensee of the Dots Creative Intellectual Property Rights may:
    1. sell, distribute, modify, transmit, re-use, re-post, copy, reproduce, republish, upload, download, post, transmit, store in a retrieval system, display, publicly perform, distribute in any way, or otherwise use any or all of the Website, Materials or Compilation or the information contained therein for any purpose other than as set out above or for public or commercial purposes without Dots Creative's or the relevant licensee's prior written permission;
    2. provide hypertext links, URL Links, graphic links, hyperlinks or other direct connection for profit or gain with respect to the Website without Dots Creative's prior written permission;
    3. display, publish, copy, print, post or otherwise use the Website and the information contained therein for the benefit of any other website without Dots Creative's or the relevant licensee's prior written permission;

    20.2 Without limitation, the use of the Website is at the User's own risk and is provided on an "as is" basis without warranties of any kind, express or implied, to the fullest extent permitted by law.
    20.3 In addition to any other disclaimers on the Website and in these Terms and Conditions and Privacy Policy, Dots Creative and any other third party mentioned on the Website disclaim all warranties, whether express or implied, including any warranties:

    20.5 All Materials including but not limiting to text, images, graphics, video, slide shows, links, names as shown in all Demo Show Booths and Demo Companies, Demo Projects, Demo Products, Demo Show Bags and any material described as Demo or intended for Demo purposes whether implied or stated are purely fictitious and are solely used as Demonstration of the concept of the approximate intended use of the Website. Final content and features of the entire Website and any part of the Website are subject to change without prior notice at the sole discretion of Dots Creative.

  21. Notices
    21.1 All notices to the User from Dots Creative or vice versa shall be in writing via e-mail.

  22. Changes to Terms and Conditions and Review and Acceptance by Users
    22.1 Dots Creative reserves the right to change these Terms and Conditions and Privacy from time to time. Dots Creative will not notify the User of such changes and the User hereby agrees that the User's continued use of the Services, including continued registration, shall constitute agreement with any changes to these Terms and Conditions and Privacy Policy.
    22.2 The User shall periodically review these Terms and Conditions and Privacy Policy as posted on the Website and the User agrees to these Terms and Conditions and Privacy Policy as they appear as part of the User's continued registration, and every time the User partakes in the Website or the Services.

  23. Severability

    25.1 There are no covenants, agreements, conditions or material representations relating to the subject matter of the Terms and Conditions and Privacy Policy, except as expressly set forth or incorporated in the Terms and Conditions and Privacy Policy.

  26. Miscellaneous
    26.1 Headings in these Terms and Conditions and Privacy Policy are used for convenience only and shall not be used in the interpretation thereof.
    26.2 In these Terms and Conditions and Privacy Policy the references in the singular shall include the plural and vice versa and references in the masculine shall include the feminine.

  27. Dispute
    27.1 In the event of a dispute between the User and Dots Creative, the User shall limit their total claim to the maximum amount they have paid to Dots Creative under this Agreement.
    27.2 In the event of any legal proceeding, the User shall bear all legal costs regardless of whether such action is brought about by the User or Dots Creative.

  28. Privacy Policy:
    28.1 The Privacy Policy applies to:
    1. any Personal Information that Dots Creative collects, uses or discloses in the course of commercial activities; or
    2. any Personal Information about an employee of Dots Creative.
    28.2 The Privacy Policy does not apply to Personal Information that Dots Creative collects, uses or discloses solely for journalistic, artistic or literary purposes.
    28.3 At the time of registration and at various times when using the Website, the User will be asked to provide Dots Creative with Personal Information. The User shall ensure that the Personal Information provided is accurate, true, current and complete. If the Personal Information is not accurate, true, current and complete, or if Dots Creative has reasonable grounds to suspect as such, Dots Creative may, in its sole discretion, cancel the User's registration. The User agrees and acknowledges that:
    1. Personal Information is collected by Dots Creative only when the User specifically and knowingly chooses to provide it to Dots Creative such as when entering a Dots Creative promotion or choosing to receive information, products or Services from a Dots Creative company;
    2. Dots Creative may also receive Personal Information from other business partners and other third parties provided that such third parties confirmed to Dots Creative that they have obtained the User's consent to the disclosure of the User's Personal Information;
    3. Dots Creative may share User's Personal Information with other Dots Creative companies and with selected third parties who are acting on Dots Creative's behalf as official agents, suppliers or service providers;
    4. Third party service providers are provided only with User Personal Information as is necessary in the circumstances;
    5. Personal Information provided to third parties may be used only for the purposes stipulated;
    6. any and all Personal Information provided to Dots Creative will be collected and may be used for the purposes of collecting data for identity ratification and records, sending the User information about different products and services, maintaining contact lists for correspondence, compiling aggregate statistics on Website usage and processing User purchase orders;
    7. Dots Creative uses cookie files to store and track information about the User when the User visits the Website and this is done:
      1. without the User being aware that it is occurring; or
      2. to enable Dots Creative to provide the User with customizable and personalized services;

    12. Dots Creative's advertisers or web sites that have links on the Website may collect personal data about the User.
    28.4 Dots Creative shall:

    30.1 Where translation service of any sort is provided by Dots Creative, the users, members, exhibitors or sponsors understand and accept that Dots Creative does not guarantee that such translation is without error. Dots Creative is not responsible for the correctness and completeness of such translation and Dots Creative shall not be liable for any cost or consequence resulting from any error or omission or misinterpretation of the translation by any party.
    30.2 Where translation is provided by users, members, exhibitors and sponsors, Dots Creative is not responsible for the correctness or completeness of such translation and Dots Creative shall not be liable for any cost or consequence resulting from any error or omission or misinterpretation of the translation by any party.

  31. Additional Terms and Conditions
    31.1 Dots Creative reserves the right to require users, members, exhibitors and sponsors to comply with additional Terms and Conditions for any physical or online component of the Tradeshow or other associated events.
    31.2 Any complimentary use of features on the Website or any complimentary service offered by Dots Creative, whether it is in the physical component or online component of the Tradeshow, is provided at the sole discretion of Dots Creative and is subject to change or cancellation without prior notice.
